Waiver of Liability

    I (the “Participant” or “Parent/Guardian” on behalf of the “Participant”) expressly acknowledge and confirm that I have/my child has voluntarily agreed to participate in the TOES FOR DANCE INC. Event, wherein it is acknowledged and understood, the Participant may be engaged in strenuous physical activities necessary in all forms and types of dance and related activities, including but not limited to, the instruction, training, rehearsal and performance of and for dance and I expressly acknowledge and understand that by participation in the Event, as aforesaid, there is the risk of bodily injury as a result of, but not limited to, contact with other Participants, instructors, walls, equipment, floors, structural aids, and other objects or things or persons located in or near the Event or bodily injury as a result of the Participant's physical condition or physical limitations.

    I expressly waive and release and forever discharge TOES FOR DANCE INC., its successors and assigns and its officers, directors, shareholders, employees, representatives and agents as well as their heirs, executors, administrators and assigns, from and for any and all claims or actions of any nature howsoever arising, known or unknown, with respect to my/my child’s participation in the Event, whether for bodily injury, property damage, costs or any loss whatsoever howsoever arising which may hereafter be sustained with respect to any and all matters in relation to my/my child’s participation in the Event.

    I hereby further acknowledge and consent to the recording of still and video images of part or parts of the Event and any or all of the participants in the Event by TOES FOR DANCE INC. and acknowledge and consent to the use of said images by TOES FOR DANCE INC., in its sole and unfettered discretion, for purposes, including but not limited to, promotional, instruction or educational purposes.

    I further expressly consent to permitting TOES FOR DANCE INC. or any affiliated corporation or entity to send e-mails to me/my child pertaining to the Event or future events; provided that I/my child may withdraw such consent by unsubscribing via the “unsubscribe link” provided with each e-mail.

    I have carefully read this waiver of liability and release and fully understand its contents and its binding effect and in the execution hereof I (and my child does) accept the terms herein voluntarily and without compulsion.
